Privacy Policy

Afni, Inc. (“AFNI,” “we,” “us,” or “our”) is committed to protecting employee privacy. This Privacy Notice explains how Afni collects, uses, discloses, and safeguards employee personal data, and outlines privacy rights employees may possess under the laws of their state, if applicable.
1. Information Afni Collects
Afni may collect the following categories of personal data:
- Identifiers: Real name, postal address, phone number, email address, employer
- Application Information: Education information, prior work experience, work status
- Internet Activity: IP address, browser type, device identifiers, and usage data.
- Sensitive Data: Financial account information, driver’s license number, Social Security Number, and geolocation data
- Biometric Information: Employees may be required to provide biometric information including, but not limited to, face prints or fingerprints.
Afni does not knowingly collect personal data from children under 13 years of age.
2. Sources of Information
- Afni may request information directly from employees to verify the employee’s identity, maintain up to date records, or process payments at the employee’s request.
- Employee Application data is primarily obtained from the applicant.
- An existing employee may provide Afni with the employee’s name, email address, and phone number for prospective positions with the employee’s consent.
3. How Afni Uses Employee Information
Afni uses employee personal data for the following purposes:
- To provide and manage benefits.
- To communicate with employees
- To complete transactions for which the information was originally obtained or otherwise in performance of a contract between the employee and Afni or Afni and our Client.
- To comply with legal obligations, exercise legal claims or rights, or defend legal claims.
- To detect and prevent fraud or security incidents.
- For internal analytics and service improvement
- To evaluate employment applications
Afni does not use your data for targeted advertising.
3. How Afni Shares Your Information
Based upon the last twelve months:
- Afni may share individual Identifiers with Afni’s Service Providers to help manage communications and benefits.
- If applying for or referred to Afni for employment, Afni may share Identifiers, Sensitive Data, and Application Information with Afni’s HR Service Providers to help process the employee’s application.
- Afni may share individual’s Identifiers and Financial Account information with Afni’s Payment Processors to process authorized payments.
- As required by law, through legal processes, or to defend against legal action, Afni may share any information with Law Enforcement, Government Agencies, Courts, Mediators, or Arbitration Bodies.
Afni does not sell employee personal data.
4. Do Not Track
As Afni does not sell your information or use it for targeted advertising Afni does not respond to Do Not Track (“DNT”) signals.
5. Employee Privacy Rights
Depending on the employee’s state of residence, the source of employee data, and Afni’s purpose for obtaining and processing the data, the employee may have rights in how Afni handles employee data. These most commonly include:
- Right to Access: Request confirmation and access to employee personal data.
- Right to Correct: Request correction of inaccuracies in employee personal data.
- Right to Delete: Request deletion of employee personal data.
- Right to Data Portability: Obtain a copy of employee data in a portable format.
- Right to Opt Out: Limit the sharing or processing of certain categories of data.

Right of Appeal: If Afni denies the employee request to exercise their rights, the employee may appeal by contacting PrivacyRequests@afni.com with the subject line “Privacy Appeal.” Afni will respond within 45 days.
6. Data Security and Retention
Afni implements reasonable administrative, technical, and physical safeguards to protect employee personal data. Afni retains employee data only as long as necessary for the purposes described in this notice or as otherwise required by law.
- Payment information will be retained only as long as necessary to effectuate employee payments.
- Call recordings, potentially containing personal or sensitive information, will be retained for 4 years unless specific state law imposes a longer timeframe.
- Video recordings of agents, applicants, and premises will be retained for up to 6 months.
- Application information will be retained for 3 years if not hired. If hired it will be kept for up to 3 years after the end of employment.
- Employee Identifiers and Sensitive Data will be kept for 8 years after the end of employment.
7. Changes to This Notice
Afni may update this Privacy Notice from time to time. Afni will notify the employees of material changes by posting the updated notice on Afni’s website and updating the effective date.
